Court Orders UP to Tackle Illegal Garlic Sale in India

Introduction

On Thursday, September 27, the Allahabad High Court summoned Uttar Pradesh Food Safety and Drug Administration (FSDA) representatives to address the illegal sale of Chinese garlic during a hearing. The case originated from a Public Interest Litigation (PIL) filed by lawyer Moti Lal Yadav in which he raised concerns about the ongoing sale of Chinese garlic in Indian markets. This sale continues despite a 2014 ban due to its harmful effects. Yadav urged the court to take immediate action against the illegal distribution of garlic in Uttar Pradesh.

Concerns Over Chinese Garlic

According to the PIL, the central government has failed to effectively control the distribution of garlic, allowing it to enter the market despite its prohibition. In response, the Allahabad High Court summoned the UP Food Safety and Drug Administration Department officer to address the issue. The court also directed India’s Deputy Solicitor General, Surya Bhan Pandey, to obtain instructions on preventing the entry of banned goods into the country.

Additionally, the court inquired about studies or reports that might help understand the smuggling methods used to bring these banned products into Indian markets. The court emphasized the importance of protecting Indian consumers and farmers from the adverse effects of tainted garlic.

Why the Ban

Reports have raised concerns over high pesticide levels in Chinese garlic, posing significant health risks to consumers. The garlic does not meet Indian food safety standards, leading to its ban in 2014. Claims of contamination with fungus and the presence of carcinogenic substances in Chinese garlic further fueled the prohibition.

Chinese garlic, widely used in Asian cuisine, is extensively produced in China. Despite the ban, Yadav’s PIL claimed it continues to be readily available in Indian markets, violating food safety regulations.
