FSSAI Flags Nestle Low Fat Dairy Whitener Sample; Company Disagrees

A laboratory analysis by the Food Safety and Standards Authority of India (FSSAI) has flagged a sample of Nestle’s Low Fat Dairy Whitener as unsafe and substandard. Food safety officials collected the sample from M/s Bharat Hotels Ltd. (The Lalit) in Connaught Place, New Delhi. An FSSAI notice confirmed the details.

What the FSSAI Analysis Found

The Food Analyst’s laboratory examined the Nestle Low Fat Dairy Whitener sample and found that it did not comply with the Food Safety and Standards Act, 2006. FSSAI then communicated the findings to the food business operator. The authority also provided a copy of the laboratory report for further action. FSSAI later issued a notice to Bharat Hotels Ltd. regarding the non-compliant Nestle product. The company received an opportunity to challenge the Food Analyst’s findings within the prescribed period under the Food Safety and Standards Act, 2006.

FSSAI Orders Halt to Sale

FSSAI directed the food business operator to immediately stop selling the identified product while the regulatory process continues. The authorities have also advised consumers to follow official updates and check product information before purchasing or consuming any affected batches. The case highlights how food safety authorities test packaged food products and take regulatory action when samples fail to meet prescribed safety and quality requirements.

Nestle Says Product Complies with Regulations 

Nestle India has said that its Low Fat Dairy Whitener is safe to consume and complies with all applicable regulatory requirements. The company explained that milk naturally contains phosphorus, which means milk-based products also contain naturally occurring phosphorus. Nestle said FSSAI laboratory reports measure total phosphorus against the applicable additive limit without separately accounting for the phosphorus that naturally occurs in milk-based ingredients.

Nestle maintained that its product complies with the prescribed limits for added phosphorus under the Food Safety and Standards Regulations, including the limits that apply when consumers prepare the product for consumption. The company also said it has been engaging with the authorities through the due process and has shared data on similar milk-based products to demonstrate the presence of naturally occurring phosphorus.
